JOSEPH GILL’S WILL (Copy)

I, Joseph Gill of Mount Pleasant Jefferson County and State of Ohio, being of Sound mind and Memory do make and ordain this my last Will and Testament in manner and form as follows:

Item lst: I give and bequeath to my son William S. Gill. The tract of land I purchased of Enoch Harris adjoining Mt. Pleasant and containing about Seventy acres with the appurtenances. Also Lot No. 26 & East part of Lot No. 24 being about Eight ft. Embracing all the ground buildings & appurtenances between the property owned by David Chambers and Thomas Shannon on Main Street Mt. Pleasant, O. Also  Three Thousand Dollars of the capital Stock of the Merchants and Mechanics Bank of Wheeling VA also legal interest payable annually during his natural life of Four Thousand Dollars. The proceeds of the rents of the Real Estate Dividends of Bank Stock and annual interest to be at his own Free disposal. The Real Estate and Bank Stock Only to be sold by & with the consent of my sons John W. Gill & James H. Gill, whom I appoint to be his Guardians.

Item 2nd: I give and bequeath to Samuel Gill. The tract of Land in Belmont County for which I have given him a deed hereby confirming the same. Also One Thousand Dollars in Cash. Also One Thousand Dollars of the Capital Stock of the Merchants & Mechanics Bank of Wheeling Virginia to him his heirs and assigns forever.

Item 3rd: I give and bequeath to William Gill. Son of my Brother Thomas Gill, One hundred & sixty Acres of land being the __ Section on which he has put up a house in Ottawa County Ohio to him his heirs and assigns forever.

Item 4th: I give and bequeath to the heirs of John Park. Eighty Acres of land it being the West half of the North West quarter of Sec.9 T6 R16 in Ottawa County O. & that Elizabeth Park, his wife, Shall have the occupancy & use thereof during her natural life.

Item 5th: I give and bequeath to Hugh Hanna and William Hanna, Sons of David Hanna also to James Park, William Park, Wallace Park, & Mary Ann Clark children of John & Elizabeth Park Eighty acres of land in Ottawa County Ohio to Each of them on condition that they Each improve and reside thereon at Least two years those tracts to be Selected & assigned to them by my son John W. Gill on above conditions them their heirs & assigns.

Item 6th: I give & bequeath to Elizabeth Ford Daughter of David Hanna one hundred and fifty Dollars to her her heirs & assigns.

Item 7th: I give & bequeath to Sarah Steen Two Hundred Dollars to her her heirs & assigns.

Item 8th: I give & bequeath to William Rankin Two hundred dollars to him his heirs and assigns.

Item 9th: I give & bequeath to John Fox, Jr. Three Hundred dollars to him his heirs and assigns.

Item 10th: I give & bequeath to Benjamin Stanton, Serv. (of whom I purchased the lower Mill Site) Two hundred Dollars to him his heirs & assigns.

Item 11th: I give & bequeath to my Grand Daughter Mary Scott Gill Five Thousand Dollars to her her heirs and assigns.

Item 12th: I give & bequeath to my Grand Daughter Nancy Gill Two Thousand Dollars to her her heirs and assigns.

Item 13th: I give and bequeath to my Grand Daughter Anna H. Gill Two Thousand Dollars to her her heirs & assigns.

Item 14th: I give and bequeath to Fanny Diew Sen. Fifty Dollars worth of clothing from J.W. Gills Store.

Item 15th: I give & bequeath to Elizabeth Jobs One hundred Dollars in cash, also one hundred Dollars worth of Clothing from J.W. Gills Store.

Item 16th: I give & bequeath to Frank (a Man of color that I raised) Thirty Dollars in cash.

Item 17th: I give & bequeath to Daniel (a Man of color that I raised) Twenty Dollars in clothing from J.W. Gills Store.

Item 18th: I give & bequeath to Samuel Norris what he is indebted to me also Twenty Dollars in clothing in Store.

Item 19th: I give & bequeath to Harrison Henry what he is indebted to me, also Twenty Dollars in clothing from J.W. Gills Store

Item 20th: I give & bequeath Two hundred Dollars on condition that there is other gifts & bequests within Seven years amounting in all to One Thousand dollars to constitute a fund to be perpetually Invested in Bank or other Stocks, the Interest from which to be applied in Educating Colored children in this Township who are Excluded from the district Schools of this Township.

Item 21st: I give & bequeath to my son James H. Gill all the Real Estate with the appurtenances within the following boundaries viz Bounded on the South by the lands of A. Lipsey, Friends burying ground, J. Parker, J.W. Watkins & Jessa Thomas.  On the East by the Road leading from Mt. Pleasant to Short Creek thence up said creek & up Hayne’s run with the line to Wm. Barchust on the North bounded by said Barchust, M. Evans & John Arnold’s line to the creek below __ Bluff rocks, thence up within the creek to Joshua Mecks line where it crosses the South Bank of the creek, thence bounded on the West by the lands of Said Meck, A. Thompson, J. Chaffon, E. Brankin, J. Parker & long run road to Amasa Lipsey land, being the place of beginning. Also the Sheep, Cattle, Hogs, Horses, Waggon & Harness & Farming utensils on Said premises. Also Four Thousand Dollars of the Capital Stock of the Merchants & Mechanics Bank of Wheeling VA also Six thousand Dollars in cash to him his heirs and assigns forever.

Item 22nd: I give and bequeath to my son John W. Gill all the residue of my Estate of every kind both real and Personal not herein given away to him his heir and assigns forever.

Item 23rd: I nominate and appoint my sons John W. Gill and James H. Gill, Executors to this my last Will and Testament hereby revoking all Wills and gifts by me heretofore made, and notifying this only as my last Will and Testament in manner and form aforesaid.

In Witness whereof I have hereunto set my hand and affixed my seal, this Thirtieth day of January in the year of our Lord one thousand and Eight hundred and forty five being 1mos 30th 1845.

The State of Ohio Jefferson Co. SS

Be it remembered that at a Special Court of Common Pleas begun and held at Steubenville within and for Said County of Jefferson, on Wednesday the seventeenth day of December AD 1845. Among other proceedings then and __ had at said Court was the following to wit.

PROBATE OF JOSEPH GILL’S WILL

In the matter of the last Will and Testament of Joseph Gill, deceased On motion to the Court by Daniel L. Collier Esq. a paper writing purporting to be the last will and Testament of Joseph Gill late of said County of Jefferson, deceased was brought into Court and John W. Watkins and James R. Hague, two of the subscribing witnesses to said paper writing being first duly affirmed and the said paper writing being exhibited to them . They Each did depose and Say “I saw the said Joseph Gill, deceased, Sign said paper writing as and for His last Will and Testament. I Signed the Same as a witness in his presence and at his request. He the said Joseph Gill at the time of the signing thereof was of sound mind and memory of the full age of Twenty one years and under no restraint.” And the Court being Satisfied that the said paper writing purporting to be the last Will and Testament of Joseph Gill deceased has been duly Executed, published and declared by the said Joseph Gill in his lifetime as and for his last Will and Testament the same is admitted to probate and together with the foregoing evidence ordered to be recorded. James H. Gill one of the Executors in said Will named appeared in Open Court and declined taking upon himself the Execution of Said Will. Thereupon came John W. Gill, the other Executor in said Will named, and being the Residuary Legatee, took upon himself the Execution of said Last Will and Testament. Special Bond ordered to be given in the Sum of Forty Thousand Dollars ($40,000.00) and James H. Gill and John W. Watkins, were approved of as securities.

Ordered that Letters Testamentary issue to the Execution accordingly~~~~
