This indenture made Jan 31st A.D. 1771 between James Sanders
of Craven County province of South Carolina of the one part & John
Smith Sr. of Bladen Co province of North Carolina of the other part
witnesseth that the aforesaid James Sanders for and in consideration
of the sum of thirty pounds proclamation money to
him in hand paid by the aforesaid John Smith the receipt whereof
the aforesaid James Sanders doth hereby acknowledge and
hereof doth fully freely & absolutely acquit and forever discharge
the aforesaid John Smith his heirs Exrs Admrs & assigns by
these presents hath given granted bargained sold aliened enfeoffed
conveyed & confirmed and by these presents doth give grant
bargain sell alien enfeoff convey and confirm unto the aforesaid
John Smith a certain tract or parcel of land lying and being
in Bladen Co. on the east side of Indian Swamp joining 200
acres possessed by a deed from Samuel Thornton to Stephen
Cole containing 340 acres Beginning on the upper side of
the Mill Branch running up the Indian Swamp for the
complement it being part of a tract containing 640 acres
granted unto David Clark by his Majesty's letters patent & by
said Clark conveyed by a deed unto Saml Thornton containing 340
acres be the same more or less & conveyed by a deed from Saml. Thornton
to the aforesaid James Sanders bearing date May 11th 1764 &
duly recorded & registered Together with all and singular the
improvements meadows ways woods waters water courses rights liberties
hereditaments and appurtenances whatsoever thereunto belonging
or in any wise appertaining and the said reversion & reversions

remainder and remainders rents (v?)ines and profits thereof To have
and to hold the said 340 acres of land with all and singular the
buildings improvements hereditaments and premises hereby granted
or mentioned to be granted with all and singular their appurtenances
and every part & parcel thereof unto the aforesaid John Smith
his heirs and assigns forever and that free and clear from all
manner of encumbrance whatsoever the one half of all gold & silver
mines together with the quit rents on the said bargained land only
excepted & reserved to the use of his Majesty and successors forever
And the aforesaid James Sanders for himself his heirs Exrs & Admrs
doth covenant promise and grant to and with the said John Smith
his heirs and assigns by these presents that he the aforesaid James
Sanders and his heirs the hereby granted premises and every part and
parcel thereof with the appurtenances to the aforesaid John Smith
his heirs and assigns against him the aforesaid James Sanders & his
heirs and assigns against him the aforesaid James Sanders & his
heirs and against all and every person and persons whatsoever lawfully
claiming or to claim shall and will warrant and forever defend by
these presents And further the aforesaid James Sanders and his heirs
and all and every other person or persons whatsoever having or lawfully
claiming or that shall or may at any time or times hereafter have
or claiming right title or interest of in or to the said pre bargained
premises or any part thereof by from or under him them or any of
them upon the reasonable request cost and charges in the law of
the aforesaid John Smith his heirs or assigns shall and will sign
seal and deliver any such further and other instruments or instruments
whatsoever for the further & better assurance and confirmation of the
hereby granted premises with their appurtenances unto the aforesaid
John Smith his heirs and assigns forever as by him or them or by him or
their counsel learned in the law shall or may be reasonably
advised devised or required In witness whereof the said party hath
hereunto set his hand and seal.
