Benjamin Port Barrows Will
In the name of God Amen this the 28th of March 1807 I Benjamin Port Barrow of
Marion District & State of South Carolina Planter being weak of body but of
sound & disposing mind and memory & calling to mind this uncertainty of this
present life & knowing that it is appointed for all men once to die do make &
ordain this my last will & testament that is to say principally and first of
all I give & recommence to the earth to be buried in decent christian burial
at the descretion of my Executors nothing doubting but, at the general
reserrection I shall receive the same again by the mighty favor of God. As
touching such wordly estate wherwith it hath pleased God to bless me with in
this life I give premise & dispose of the same in lthe following manner & form.
I appoint my funeral charges & all my other debts first paid.
Item. I give and bequeath unto my well beloved mother Ann Rourk twenty two
dollars in cash.
2nd. I give and bequeath to my beloved sister Mary Daniel twenty two dollars.
3rd. I give and bequeath to my beloved sister Rachel Ballard, the sum of
twenty two dollars.
4thly. I give & bequeath to my beloved James McRee Daniel the only child
living of my siter Mary Daniel one negroe woman by name Binkey & her child
Reubin & one white mare & the half of all my lands.
5thly. I give & bequeath to my two nieces Ann Ray Ballard Caroline Ballard, the
daughters of my sister Rachel Ballard six negroes by name Ebby, Cellar, Aneca,
Washington, Harry. Life the other half of all my lands.
6thly, I lend to my sister Rachel Ballard the work or labour of the above six
negroes during her natural life & the use or profit of the land by renting it
or tending, and should my sister Rachel Ballard have any more children they are
to have an equal share of what I have left to my two nieces by name, Ann Ray
Ballard & Caroline Ballard share & share alike.
7thly. I leave to my sister Mary Daniel the use of two negroes & the half of
the land that I give to my nephew James McRee Daniels during her natural life,
the remainder part of my estate to be sold to pay my debts with all that is
...ursic... to me should there not be sufficient to pay all my debts they must
be paid out of what I have given to my two nieces Ann Ray Ballard &
Caroline Ballard. My will is that if either Ann Ray Ballard or Caroline
Ballard or either of the children of my sister Rachel are without ... their
shares or share is to be divided equally among the then surviving children of
my sister Rachel Ballard. I likewise make, constitute, nominate & appoint as
my only & sole executors of this my last will & testament Mary Daniel & Rachel
Ballard. I do hereby renounce, revoke and disanull all former wills testaments
& bequeaths by me in any wise made before this time & hereby ratify & confirm
this and no other to be my last will & testament in writing
whereof I have hereunto set my hand & live this day and year above written. Sign &
Sealed Published pronounce & declared by the said Benjamin Port Barrow to be his
last will & testament in the presence of us the subscribers.
