THOMAS HARLLEE SR.
State of South Carolina ) In the Name of God Amen.
Marion District ) Know all men by these presents that I Thomas Harllee
Sr. of the State and District aforesaid, being well in body and of sound and
disposing mind and memory thanks be unto God for the same, but calling to
mind that it is appointed for ale men once to die, do make constitute and
ordain the following Instrument of writing to be and Contain my last wile
and Testament. (To Wit)
Item. First of all I recommend my soul to Almighty God who gave it and my
body after my decease I wish to be buried in a decent Christian like manner
at the discretion of my Executors herein after named And as it concerns the
worldly Goods and property that it has been pleased God to blefs me with I
give bequeath and devise in the following manner (to Wit)---
In the first place it is my Wile and desire that ale my just debts shale be
paid.
Secondly. I give bequeath and devise unto my beloved Wife Anna Harllee ale the
household and Kitchen furniture that she was pofsefsed of in her own right
previous to our marriage, that may at this be on remaining Also one bay Horse
named Bale and 1 Spotted horse named Span, Also Six cows and Calves and ten
head of young Cattle, to be at her own disposal. I also lend to my two Executors
herein after named the following property (To Wit) One Negroe Man named
Caesar & his wife named Rena and her three children Drusilea Giles & John
with the exception of Giles & John to be delivered to my Son William Harllee
when he arrives at the age of Twenty One Years as hereafter bequeathed, I
also loan to my Executors as before One negroe woman named Dina and her two
children (to wit) One negroe woman named Hannah and one Negroe boy Sol, and
Hannahs & Child Mariah, the negroe boy Sol to be delivered to my Son Robert
Harllee when he arrives at the age of Twenty One Years; I also loan as
aforesaid to my Executors One negroe man named Aaron One negroe man named
Buck and one negroe man Adam,. All the property above loaned to my
Executors is at their discretion for the maintainance and support of my Wife
Anna Harllee and after maintaining and supporting my said wife Anna Harllee
in a decent manner at the discretion of my Executors then any balance that
may arise from the work or hire of said Negroes, to pafs into my surplus
property.
Thirdly, I give bequeath and devise unto my beloved Son John Harllee One
Negroe man named Abrame Also one sorrel Horse called Cofer, also 1 Bridle &
saddle and all the notes and accounts that he is due to me or that I have
paid for him also 1 Bed and furniture to him his heirs and afsigns forever,
Fourthly I give bequeath and devise unto my beloved Daughter Anna McNeill
Three Hundred & fifty Dolears, to her heirs and afsigns forever,
Fifthly, I loan to my beloved daughter Elizabeth Bethea during her natural
life and no longer the following Negroes, (To wit) One Negroe Woman named
Tilda One negroe girl named Nancy and one negroe girl named Sophia with
their future increase said Negroes at the death of my said Daughter, with
their future increase to go to the lawfule heirs of her body and I leave my
Two Executors herein after named as trustees of said property for the use
and behoof of my said grand children after the death of said Daughter, to be
dvided among them share and share alike, to them and their heirs and afsigns
forever.
Sixthly, I give bequeath and devise unto my beloved Son David S Harllee One
Negroe man named Joe One Negroe boy named Stephen and after the decease of my
Wife I give and bequeath to my son David S. Harllee aforesaid One negroe man
named Aaron, I also give my Said Son David S. Harllee One Bed and furniture
and Ten head of Cattle, I also give to my grand child James Jacob Harllee son
of David S Harllee One negroe boy named Alford (son of Ufsa) ale of Which
property is to be given to my said son David S. Harllee at my decease except
Aaron as above stated which he is to receive at the death of my Wife to him
his heirs and afsigns forever,
Seventhly, I give bequeath and devise unto my beloved Son Thomas Harllee Jr.
One Negroe Man named Bob and One Negore Man named Henry and the following
tract of land (to wit) commencing on my line on the road that lends to mars
Bluff near John Ropers field thence along said road towards the Bridge untile
it comes to the melting House Branch (which is also the dividding line between
David S. Harllees land and Thomas Harllee Jr land) thence down said branch into
the River thense up the River to my line thence along my line to the mouth
of the mile branch thence on the West side of said mile Branch to high Water
mark until it goes to the fork of said branse over the road thence along the
South prong of said branch and from the head of said Branch to strike the
deviding line between me and Mr. Proctor near the path that pafses from the
cashway road to John Hairgrove’s, thence along my lines to the road at the
beginning place near John Ropers field, including the last purchase I made
of Stephn Gibsons which includes Grooms Bay I also give to my said Son
Thomas Harllee One Bed and furniture and three cows and calves, to him his
heirs and afsigns forever, I also give my Son Thomas Harllee four acres over
the Bridge adjoining the Bridge, for its use.
Item, I loan to my Executors herein after named for the Special use and
behoof of my son Peter Harllee the following property (To Wit) Four Negroes.
(Viz) One negroe woman named Jin and her three Children Moses, Caleb, and
Dick, Also ale the lands that I own on the N. E. Side of Little Pee Dee River
that lies below the lightwood not Branch, except what is heretofore given
for the use of the bridge viz. four acres on it this Bridge adjoining the
bridge which is given to my Son Thomas Harllee Also One bed and furniture and
four cows and calves or their value in other cattle, all of which property
is left for the maintainance of my said son Peter Harllee and when my Executors
shall think that my son Peter Harllee shale come and stay perfectly
in his senses, then so long as he is perfectly sane they my Executors shale
diliver the property aforementioned to my said son Peter Harllee to him his
heirs and afsigns forever, otherwise should they not think him at any time
in his senses or should he be deemed not So then this property to be hired
and rented out for his benefit by my Executors at their discretion.
Ninthly I give bequeath and devise unto my beloved son Robert Harllee One
Negroe boy named Sol when he arrives at the age of Twenty One Years and at
the death of my wife Anna Harllee I also give my son Robert Harllee One Negroe
Woman named Hannah and her child Mariah with their future increase It is
also wile and desire that Robert Harllee Shale be Educated as a Physician and
attend lectures until he is properly qualified as a Doctor of Medicine and
the expenses to come out of my surplus property which is undivided, To him
his heirs and afsigns forever,
Tenthly. I give devise and bequeath unto my beloved Daughter Harriet Harllee
the Six foleowing Negroes (To Wit) Sarah with her five children (To Wit)
Usea Dublin John Frank & Andrew, and their future increase also 1 Sorrel
mare One bed & furniture and 2 Cows & Calves - To her and the Heirs of her
body forever.
Eleventh, I give devise and bequeath unto my beloved Son William Harllee
when he
Two Negroes/is the age of Twenty One Years the two foleowing negroes Giles &
John and at the Death of my wife Anna Harllee I give him the foleowing
Negores Caesar Rena & Drusilla with their future increase. I also give my son
William Harllee the foleowing tract of Land adjoing and lying above the
lands already givn to Thomas Harlee Jr. beginning on the West Side of the
Mile Branch at high Water mark thence along said branch untile it forks
thence along the South Fork of said branch to the head thence along Thomas
Harllee Jr line untile it intersects with the dividng line between Mr. Proctor
and myself thence along my lines back to the beginning near the mouth of the
mile Branch. Two Cows & Calves and 1 Bed and furniture to him his heirs and
afsigns forever,
Twelthly. It is my wile and desire that ale my surplus Estate shale be sold and
ale debts due to me to be collected by my Sons Davis S Harllee & Thomas Harllee
and for their trouble in collecting my debts they are to have the use of the
same for three years after my death free of Interest, and after ale my Just
debts are paid and legacies paid out then at the Expirated of the three years
above mentioned then ale the Balance remaining I wish divided among my Nine
Children Share and Share alike (To Wit) John Harllee Anna McNeile Elizabeth
Bethea David S. Harllee Thomas Harllee Jr Peter Harllee Robert Harllee Harriet
Harllee & William Harllee Share and Share alike---
Thirteenth. It is also my wile and desire that if any of my children heretofore
named Should die wst leaving no lawfule ifsue of their body then the
properly bequeathed to them to return back and be divided between my living
Children share and share alike
And Lastly, I do hereby nominate constitute and appoint my beloved Sons David
S Harllee & Thomas Harllee Jr Executors to this my last wile and testament
and I do herbyrevoke and disannul ale other wills by me here tofore made and
ratifying and confirming this to be and contain my last Wile and Testament.
In Witnefs Whereof I have hereunto set my hand & Seal the Twenty third day of
September in the year of Our Lord One Thousand Eight Hundred and Twenty Six
and in the fifty first year of the Independence of the United States of America.

CODICIL TO THE FOREGOING WILL
Be it know that I Thomas
Harllee maker of the foregoing Will wishing to alter a small part
of my will do the same by this Codicil, vis -
It is my will and desire that
the negroe boy John Sarahs Son heretofore givn to my Daughter
Harriet Harllee I give and bequeath to my Son Robert Harllee I
also give to my Son Robert Harllee One hundred Dolears out of my
Surplus property in order to purchase him a Horse. It is also my
Wile and desire that at Twelve months after my death all The
monies That are collected over paying The bequest heretofore
given be divided as heretofore bequeathed, I also nominate
constitute and appoint Malcom McInnis as an Executor with my two
sons David S. Harllee & Thomas Harllee Jr. before named in my
will. In witnefs whereof I have hereunto set my hand to this the
codicil of my last Wile and testament this 3d day of
February in the year of Our Lord One Thousand Eight Hundred &
Twenty Seven and in the fifty first year of American Independence
