WILL OF
RICHARD HOWARD
In the name of God Amen I Richard Howard being at this time of sound and
disposing mind and memory do make this my last will and testament.
In the first Place I desire that my just debts be paid.
To John Collins who married my daughter Mary and to John McClenaghan who
married my daughter Matilda I give and bequeath one dollar each in addit-
ion to what I have already given them.
To Elizabeth Jolly daughter of Joseph A. Jolly I bequeath five hundred dol-
lars.
All the rest and residue of my estate real and personal I bequeath to my
son Charles B. Howard and to my daughters Sophia E. McIntyre and Emily Mc-
Clenaghan to them their heirs executors administrators and assigns forever
to be equally divided between them and I do hereby constitute and appoint
Francis Hinds James McPherson Evander A. McIver Joseph A. Jolly David Ken-
nedy and Reash Cannon or Any three of them surviving or two of them with
upon disagreing power to choose a third man to decide between them to
meet together and on the decision of a majority of those assembled to make
the division between my three last mentioned children as soon after my de-
cease as either of executors shall call upon them to meet and as is
convenient for them to assemble and their decision shall be binding and
conclusive between the parties without the necessity of requiring the con-
currance of any Court to ratify their award
I nominate constitute and appoint my son Charles B. Howard and my sons in
law Archibald McIntyre and Horatio McClenaghan executors of this my last
will and testament
Witness my hand and seal this twenty first day of May in the year of our
Lord one thousand eight hundred and thirty one
