In my endeavor to transcribe this will, you will find a blank space when
word/s can't be interpreted by me, question marks in brackets beside some
words when I am unsure, and complete word/s within brackets when I am 90%
sure or am able to hazard a probable guess. This will is written in a much
clearer hand than many and the photocopying is superb. The spaces between
paragraphs are inserted by me when the sentence ends in the middle of the
sheet, or near the end. Most documents I've seen use the complete sheet of
paper, from edge to edge. Therefore, I interpret the leaving off of a
sentence in the middle of a line as a pause, or interjection of another
thought and have made a paragraph to show this unfinished line of script.

I John Mace Sr do make ordain and declare this Instrument to be my last Will
and Testament revoking all others. In the first place all my debts of which
there are but few and non[e] of magnatude are to be punctualy paid and the
legaces here after bequeathed are to be discharged as soon as circumstances
will permit and in the manner directed in the fowling [following] Items
Item To my dearly beloved wife Marthy Mace I give and bequeath one negro
woman named Dinah as I also do my house hold and kitchen furnature of every
kind with the Horses and stock of every kind and farming tools and crop that
may be on hand at my death only so much as it may take to pay my debts at
that time with what may be due to me at that time is to be collected and paid
out as fare [far] as it will go and If there is any left it is to be kept by
my Widow
Item To my son Mathew Mace I give and bequeath one negro man named Peter
which is in his possession and the Land which he lives on all lying North of
the Mill from high water mark on the south side ...
Item To the heirs of

which negro is in the possession of the Estate I add nothing to it because
of the ample provision I have made for them by Title :
Item To my Daughter
Elizabeth Moody I give and bequeath three Negros known by the name of Rachel
Bill and [Ketter] ....
Item to my Daughter Martha Edward I give and bequeath five [negros] known by
the name of Mary Barb Tobias Daniel and Malcom and if the said Martha Edwards
shall dye without a lawful issue the property is to be returned and Equally
divided [between] all my heirs which negros will be in the possession of
Edwards after the first of January 1846 Item To my Daughter Frances Roberts
I give and bequeath one Dollar I add nothing to it because I have made a
provision for her by Title ...
Item To my Granddaughter Martha Jane Monro I
give and bequeath two negros known by the name of Charlot and [Verch] wich
negros I give in satisfaction of a land that I gave in satisfaction to her
father which I consider an equal share with the rest of my daughters and If
the said Martha Jane Munro [word scratche thru] should dye without a Lawful
Issue it is my will that the Property shall be returned and Equally devided
amongst all my heirs
Item To the heirs of My Daughter Mary Crawford I give and bequeath Two negros
known by the name of June and Luke which negros are in the possession of
Mahaleeal Crawford the Father of said heirs ..
Item to my Daughter Sarah
White I give and bequeath one Dollar in money. I add nothing to it because
of the ample provision I made for her by Title
Item To my Son John Mace I give and bequeath one Dollar in money I add
nothing more to it because of the ample provision I have made for him by Title
Item To my Daughter Rhody Lewis I give and bequeath one Dollar in money I add
nothing more to it because of the ample provision I have made for her by Title
Lastly To my Beloved wife I gve and bequeath all my property as above
mentioned Except such as may be claimed by my son James for such as is claim
by him is his own and the balance is my beloved wife Martha Maces to use as
she sees fit
Lastly I constitue and appoint my son Jon Mace and John Roberts Executors of
this my last Will and testament I hope and trust no dispute will arise
concening the Legaces bequeathed but If contrary to Expectation any dispute
should arise . My will and direction is that all disputes if any should arise
shall be decided by The Intelligent men Two to be chosen by the disputants
each having the choice of one the third to be chosen by the two which three
men shall declare the testators intentions and [sole/said] decision is to all
intents and purposes to be as binding on the parts as If it had been given in
the Supreme Court of the United States. In witness of all thing here in
contained I have set my hand and fixed my seal
