WILL OF DANIEL McINNIS
South Carolina ) In the Name of God Amen, I Daniel McInnis of this State
Marion District ) and District being of sound and disposing mind and judge-
ment knowing that all men must die. and after death must answer for their
sets on earth at the great judgement which is in the future to be, all of
which I do steadfasly believe in Being prompted to these reflections from the
feet of my long and continued low state of Health feeling that before long
I must be done with all that pertains to me on earth. I do therefore consti-
tute this and declare it to be my last Will & Testament to be. as Follows,
vis. I give and bequeath to my beloved son James P. McInnis and the lawful
heirs of his boddy, if he dies leaving any such heirs. and/if he does not leave
any such heirs for them to revert back to my two daughters Margaret & Jes-
tinar McInnis and the heirs of their boddy, My two negroes. Glen & Giles and
their increase. I also give to my son James P. McInnis one young mare,
named Kit, Two sows & yearlings, including the one he now has in pofsifsion,
and my Black shep & wood shop Tools.
I give and bequeath to my two daughters Margaret & Jestiner McInnis, or the
survivor if either of them should die leaving no heir from her boddy, but
should they both have heirs from their boddy to said bodily heirs equally.
all my Lands. Horses. Tenaments & free held/estate being the same on which I now
live lying on both sides of Little Pee Dee river supposed to be five hundred
acres the same being more or lefs. I also give to my Two daughters Margaret
& Jestiner all my household and kitchen furniture. Plantation and farming
Tools, cart. and Buggy. Two work creatures. Twelve head of cattle (including
cow & calf as one) as much of my stock of Hogs as they may need. my stock
of sheep my. crop provinder & provisions so much of it as they may need for
their years support.
I give and bequeath to my daughter Margaret McInnis and the heirs of her
boddy if she dies leaving such heirs but if she dies leaving no such heirs
to her sister Jestiner McInnis and the heirs of her boddy. my three negroes
vis Ana. Harriet andcharise & their increases.
I Give and bequeath to my daughter Jestiner Mc and the heirs of her
boddy if she dies leaving such heirs but if she dies leaving no such heirs to
her sister Margaret McInnis and the heirs of her boddy. My three negroes vis
Lydia, Neely and July and their increase. And it is my wile & desire that
my negro boy Harry. one waggon one Mule and all other of property not being
disposed of in the foregoing bequest. I wish sold and proceeds applied in af-
sisting my other means to pay just debts and should/their be a surplus after meeting
all such contingencees for it to be equally divided between my three children.
James P. Margaret & Jestiner and further more I constitute and appoint my two
friends Neill McKinnon & Robert C. Hamer Trustees to superintend and guard
that part of the foregoing bequest as I have made it to my two daughters
Margaret McInnis & Jestiner McInnis. And farther more nominate &
said friends Neill McKinnon & Robert C. Hamer the lawful and true officers
to sittle my estate and the foregoing bequests. In witnefs whereof I do
hereunto set my hand and seal. This the fourteenth day of November A. D. one
thousand eight hundred and forty nine.
