WILL OF
JOHN RICE
I John Rice in the name of God Amen do make this my last will and Testament.
First I recommend that my body after death be decently buried.-
Secondly after all my Just debts are paid I give to my beloved wife Elizabeth
Rice for and during the term of her natural life, - the plantation and tract
of Land, where I now live. Also. With the same limitation, two Negro ---- by
the names of Crifsey and Desday - also all the horses Cattle hogs plantation
tools Etc. after her death as follows, Crifsy to Mary Davis and the lawful
ifsue of her body forever - and Defday to my Grand daughter Mary Elizabeth Philips
daughter of Katharine Philips and the lawful heirs of her body forever.
Thirdly - To Jane Davis wife of George and the lawful ifsue of their bodies
forever - I give (after the death of my said wife) the Lands on which I now
live and all adjoining lands thereto, supposed to Contain in the whole, five
hundred acres - lying on the out Back swamp of Catfish also the following
Negroes - Mary, Dolly, Prince and Will.
Fourthly - to my Daughter Katherine Philips wife of Zachariah L Philips and the
lawful ifsue of her body forever a tract of Land Called the "River Swamp tract",
lying in Marion District Containing five hundred and twelve Acres - also the
following Negroes a wench by the name of Susan, Boy Caleb and fam,
Fifthly - to my Daughter Mary Davis wife of Abijah Davis, and to the lawful
ifsue of her body forever the following Negroes, Sally, Judy, Ebby, Peter,
and Harry.
Sixthly as this is my deliberate will I trust there will be no future
controversy or dispute concerning the same.
Seventhly - There is a debt due me by II Davis of Alabama when Collected,
I desire that my Executors should equally divide the same among the heirs
above mentioned that is my children share and share alike
Lastly I nominate constitute And appoint George Davis and my friend
Ed. B. Wheeler Executors of this my last will and Testament - Witnefs my hand
and Seal 20 day of Sept. A. D. 1836
