WILL OF LOT ROGERS

                        )
Marion District         )  In the name of God Amen.  I Lot Rogers of

the state and District aforesaid being weak in body but of sound and dis-
posing mind and memory thanks be to Almighty God for the same but calling
to mind the mortallity of my body and Knowing that it is appointed for ale
men once to die do make constitute and ordain the following instrument of
writng to be and contain my last wile and Testament in manner and form fol-
lowing first of ale I recommend my Soul to Almighty God who gave It and my
body to be buried in a decent Christian like manner at the descretion of my
Executors, hereinafter named nothing doubting but at the general resurrec-
tion I shale receive the same and as touching such worldly Estate as it has
been pleased Almight God to blefs me with I give devise and bequeath in the
folowing manner & form (To wit.)

First, I loan to my wele beloved wife Anne Rogers All my Estate both real
and personal during the term of her natural life and no longer, consisting
of the Land whereon I now live and the land where my Son Elisha Rogers lived
at the time of his death.  Also all my stock of Horses Cattle and Hogs and
Sheep also ale my plantation tools of every description.  Also ale my House
hold & Kitchen furniture also ale debts due to me by note or account I wish
coleected by my Executors and if there should be any over paying my just
debts to be paid to my wife and if there Should not be enough collected to
pay my debts then I wish my Executors to sell enough of my personal Estate to
do so the property to be designated by my wife of that she can best Spare--

Secondly to my son David Rogers after the decease of my wife I give Eight
Dolears to be raised out of sales of personal property.

Thirdly to my son Timothy Rogers After the decease of my wife I give five
Shilings lawfule currency of this state to be raised as aforesaid.

Fourthly To my Son Robert Rogers after the death of my wife I give five
Shillings lawfule currency of this State to be raised as aforesaid.

Fifthly. To my son Noah Rogers after the death of my wife I give the Land
Whereon my son Elisah Rogers lived at the time of his death containing One
Hundred & Twelve acres and divided from the land whereon I now live by a
divisional line made for that purpose to him his heirs and afsigns forever

Sixthy to my- Daughter Sally Legett after the death of my wife I give
One bed and furniture

Sevently to my Son Wileiam [William] Rogers after the death of my wife I give dis-
pose and bequeath the land whereon I now live containing One Hundred &
Twelve acres and divided from the land before wiled to Noah Rogers by a
line made for that purpose to Him his Heirs and assigns forever.

Eightly To my Son Phillip Rogers I give after the death of my wife five
Shillings lawfule money of the said State to be rased out of sales of personal
Estate.

Ninthly. To my grand Children now living with me viz. Martha Rogers and David
                                                                      Children
Rogers after the death of my wife I give a Cow and calf a piece and the/to
remain with my wife until they arrive at the age of Twenty One Years--

Tenthly. To my grand children Wileiam [William] Sadey [Eadey?] Nathan Evans & Elizabeth Ann
Evans I give five Shillings lawfule currency of the said State, to be raised
after the death of my wife by Sale as aforesaid--

Eleventh. Ale the rest and residue of my property not before bequeathed I
give to my wife Anne Rogers to be at her own disposal. --

Twelfthly. Lastly I do hereby nominate constitute and appoint my two be-
loved Sons Noah Rogers & Wileiam [William] Rogers Executors to this my last wile and
testament hereby disannulling and revoking ale former will & wills by me
heretofore made and hereby confirming this to be and contain my last wile
and Testament.

     In Witness whereof I the said Lott Rogers have hereunto set my hand and
affixed my Seal this 28th day of March In the year of our Lord One Thousand
Eight Hundred and Twenty nine & in the fifty third year of American Inde-
pendance.

Signed Sealed published prounced and                   Lot Rogers (SEAL)
declared to be and contain the last wile
and testament of the said Lot Rogers who hath
hereunto Set his hand & Seal in the presence of
us and in the presence of each Other

This Will was transcribed from a copy of a WPA transcription done in the 1930s. It would appear the transcriber saw a double-l (ll) as "le"; e.g., "ale" for "all", and of course wrote "fs" for the fancy, elongated "s" used where the letter is doubled. I have made but one change to the WPA transcription: where the copy I worked from reads "Wileam", I added [William] soley to assist a page search. As always, please consult the original document.--vp
