This Indenture made the tenth day of September in the fifteenth year of the
Independence of America and in the year of our Lord one thousand seven
hundred and ninety, between William Luke & Elizabeth his wife, in the county
of Marlborough in the State of South Carolina, School Master of the one part
and John Daniel of the county and state aforesaid, planter, of the other part
witnesseth that whereas his Excellancy William Bull, Esq. then governor of
this State by deed of Grant bearing date the fifteenth day of September One
Thousand Seven Hundred and Forty Three under the Great Seal of the State
for the consideration therein mentioned did give and grant unto John Luke,
his heirs and assigns forever all that parcel or tract of land containing four
hundred acres in the Welch (sic) Tract on Peedee River in the County and State
aforesaid, having such shape, form and marked trees as appears by a Plat
thereof unto the said Grant annexed, reference there unto being had may more
fully appear and whereas by a bargain & sale the said John Luke did on the
second and third days of May one thousand seven hundred and firty-seven
Convey by Lease and Release of that date unto Joseph Luke, his heirs and
assigns, his moity or one hundred and thirty three acres of said tract of land
taken of the upper part of said tract and was from him conveyed to William
Luke by heirship. Now this Indenture witnesseth that the said William Luke
& Elizabeth his wife, for and in consideration of the sum of one hundred
and twenty pounds Sterling money to him in hand paid at and before the
Ensealing and Delivery of these presents the Receipt whereof is hereby
acknowledged have bargained, sold and by these presents do Grant, bargain
and sell unto John Daniel, his heirs and assigns forever all that plantation or
part of a tract of land, containing one hundred thirty three acres taken of the
upper part of the said tract of Four Hundred acres Together with all & singular
the houses, out houses, yards, gardens, ways, paths, passages, liberties and
privledges thereunto belonging or anywise appertaining to the premises hereby
granted and hereby intended to be hereby granted & the provisions and revisions
remainder and Remainders , Services, profits & benefits of the said one hundred
and thirty three acres Land & all rights, claims, interests, securities relative to the
same, To Have and To Hold the said tract of one hundred and thirty three acres
of land and other premises unto the said John Daniel, his heirs and assigns forever
to their only proper use and behoof & the said William Luke & Elizabeth his wife,
for themselves, their heirs, Executors & administrators & every of them shall
and will warrant and forever defend the above recited tract of land or part of a
tract containing one hundred and thirty three acres of land and premises unto the
said John Daniel, his heirs and assigns forever against him the said William Luke
& Elizabeth, his wife, their heirs _____ every person or persons whatever in
Witness whereof the said William Luke & Elizabeth his wife hath hereunto set
their hands and seals the day and year first above written.

for the County and State aforesaid personally appeared
Peter Smith who being Duly Sworn sayeth that he saw
William Luke & Elizabeth Luke, his wife, sign, Seal and
as their Act & Deed Deliver unto John Daniel the within
Instrument of writing for the use ____ intent and purposes
therein mentioned and that he saw Jesse Wilds and
Susanna Smith sign the same with him as Evidence.
