Joshua AMMONS, 1831

The State of South Carolina.

In the name of God. Amen. I Joshua Ammons of Marlborough District and State of aforesaid being weak and infirm in body but of sound and disposing mind, memory, and understanding, do make and ordain this my Last Will and Testament. First I commit my Sould (sic) into the hands of God who gave it and my Body to the Earth to be buried in Christian like and decent manner, at the discretion of my Executors.

Item 1st I Lind (sic) to my beloved Frances during her natural life my house and plantation whereon I now live or as much thereof as she may have use of at her own discretion. I also will to her, during her life time, all my Stock of every kind, and all my household and kitchen furniture, and all my farming Utensils with full privilege of timber and firewood on every part of my land, herein to be willed to my son James.

2nd I give to my daughter Kiddy Graham one dollar, and no more as I have heretofore advanced her to a full portion or Share of my Estate.

3rd I give to my son Jesse Ammons one dollar, and no more, as I have heretofore advanced him to a just and full Share or portion of my Estate.

4th I give and bequeath to my daughter Frances and my granddaughter Winny Jane, daughter of my son Joshua to be equally divided between them, all that tract or parcel of land containing about One hundred and fifty acres (more or less) marked out or recited as follows: beginning at the fork of the roads leading to Fayettville and Lumberton then a North Course to the run of the Creek called the three Creeks being a prong of the three Creeks. Thence up with the Channel of said Creek to a Corner Gum at a corner of John Hamer's land, thence up with a run of a small branch towards the road leading to Fayettville then with a line of marked trees to said road. Thence with said road to the beginning, at the fork of the roads. To them the said Frances and Winny Jane their heirs and assigns forever, if they or either of them should have lawful issue, and if they or either of them should happen to die without lawful issue, then the land hereby bequeathed to such to revert to all my children except my son Jesse and my daughter Kiddy.

5th I give and bequeath unto my daughter Celia Ammons all that piece or parcel of land lying between or in the fork of the road leading to Fayettville and the road leading to Lumberton bounded by said roads, and John Hamer's and Robert D. Thomas's land, to her and her heirs forever, if she should leave lawful issue. But if she should have no lawful heir, the same to revert to all other children except my son Jesse and my daughter Kiddy Graham.

6th I give and bequeath unto my son James Ammons and my daughter Levicy Hargroe, to be equally divided between them, Share and share alike to be possessed by them immediately after my wife's decease all the remaining part of my land whereon I now live containing estimation about three hundred acres (More or Less) all except the part herein disposed by the Tract Granted to me by Thomas Bennet Esq. Governor and bearing date the third day of June Anno Dominae One Thousand eight hundred and twenty two to them and their heirs forever.

7th I give and bequeath unto my daughter Elizabeth McDaniel all that piece or parcel of land containing twenty one acres bounding between Simion Horton's and Jesse Ammons lands, to her and her heirs forever.

8th I hereby appoint my beloved Wife Frances Ammons and my son in law Neavel Hargroe Executrix and Executor of this my last Will and Testament. In Witness whereof I have hereunto set my hand and seal this third day of September in the year of our Lord One Thousand eight hundred and Thirty one.

I Joshua Ammons, through the providence and Mercy of the Lord do continue to be of sound and disposing mind, memory, and understanding, do hereby make the following Codicil to this my within written last Will and Testament, that is to say, Whereas in the fourth clause of said Will I did give and bequeath to my daughter Frances, and my granddaughter Winny Jane daughter of my son Joshua Ammons A certain piece and parcel of land therein recited but not mentioned in what manner the same is to be divided between them. I do now hereby authorize and empower my therein named Executrix to choose either three or five men to act as commissioners to divide the said land between the said Frances and Winny Jane and that said division shall be good and permanent. Also as I omitted mentioning the name of my daughter Sarah Horton in my Said will, give to her one dollar and no more, as I consider that I have heretofore advanced her to a full Share of my property. I witness whereof I hereunto Set my hand and seal This May 5 day in the year of our Lord One thousand eight hundred and thirty two.
