WILL OF JOHN HUBBARD

IN THE NAME OF GOD AMEN

I, JOHN HUBBARD, of the District of Marlborough in the state of South Carolina, being in reasonable health of body and of sound mind and memory thanks be to God for the same, do make this my last Will and Testament in manner following.

First, I give and bequeath to my beloved wife, [* JANE MCNATT ] should she survive me, an equal share with my chidlren, that is, one Seventh part of my whole Estate, both real and personal, after all my just debts are paid.

Second, I give and bequeath to my daughter Lucy, wife of Philip BARRENTINE, Eight hundred dollars.

Third, I give and bequeath to my daughter Mary, wife of Handa STANTON, Eight hundred dollars.

Fourth, I give and bequeath to my son William HUBBARD, Seven hundred dollars.

Fifth, I give and bequeath to my daughter Sabia, wife of Thomas STANTON, seven hundred dollars.

Sixth, I give and bequeath to my son Peter HUBBARD, Seven hundred dollars.

Seventh. It is my will and desire that all the rest and residue of my property, after above legacies are paid by my Executors, be equally divided among all my children, namely, Lucy, Mary , William, Sabia, Roberson & Peter, Share and Share alike.

Eighth, It is my will and desire that my Executors hereafter naned, as soon as convenient, after my death, choose three or five disinterested men to value and appraise my negroes, and if said negroes can be so divided as to pay the legacies named in this my last will & testament satisfactorily to my children, It is my desire that said legacies be paid in negroes, but if my negroes can not be satisfactorily divided among my children in payment of their legacies I will & direct that the negroes be sold by my executors and the legacies paid to my children in money. I also will, request and direct that all my lands be sold by my Executors on such terms as they may think best, and the money arising from the sale of the same be distributed as directed in this my last Will & Testament.

Ninth, I do hereby nominate constitute and appoint my son William HUBBARD & Philip ODOM Executors of this my last will & testament.

Signed, sealed published and declared by JOHN HUBBARD to be his last will & testament in the presence of us who have hereunto subscribed our names as witnesses, in the presence of the testator. January 20th, 1848
