In the name of God amen.
I WILLIAM PEGUES of the District of Marlborough and the State of South Carolina being of sound and disposing mind memory and understanding, do make this my last Will and Testament in manner and form following; hereby revoking and annulling all other Wills and Testaments by me at any time heretofore made.

1st. I give, grant, devise and bequeath to my beloved wife MARIA PEGUES and our two children CATHERINE E. PEGUES and EMMA WILLIAM PEGUES all my lands lying on the east side of Great Pee Dee River, to them their heirs and assigns forever. I also give and bequeath unto the said MARIA PEGUES CATHERINE E. PEGUES and EMMA WILLIAM PEGUES the following named negroes Viz. WISDOM, ANIKA, REBECCA, MESHACH, SAHDRACK, EDMOND, JUNO, FLORA, MARTHA, & NERO and the increase of the same to them and their heirs forever.

Secondly. I give and bequeath to my son MALACHI PEGUES the sum of one thousand and five hundred dollars.

Thirdly. I give and bequeath to my daughter ANNE POPE one thousand dollars.

Fourthly. I give and bequeath to my daughter MARY REYNOLDS one thousand dollars.

Fifthly. I give and bequeath to the children of my son JAMES PEGUES deceased all the monies that may arise from the sale of the two negroes BETTY & MARGARET as herein after described.

Sixthly. I give and bequeath unto my beloved wife MARIA and our two children before said my carriage & horses and four other head of horses and ten head of cattle such as my wife may select from my stock of horses and cattle together with one half of my stock of hogs, and I further give to my said wife corn, fodder & meat sufficient for the use of her family and plantation for one year -- the year to commence from the first of January next after the sale of certain of my lands & negroes as is hereinafter provided; in the meantime; it is my will that she

and her family be supported out of my Estate.

Seventhly. It is my Will that my negro man RENT be set free as far as it can be done consistent with the Laws of this State, and I request my friend the REV'D WM. JACKSON to act as his guardian.

Eighthly. It is my will that the two old negroes BAILY & his wife SAPPHO remain and be supported on the plantation devised above.

Ninth. I will and bequeath to the REV'D WILLIAM JACKSON the sum of one hundred dollars.

Tenth. All the rest and residue of my estate real and personal I hereby direct to be sold by my executors leaving it to their discretion to fix the time when and the terms upon which such sale is to be made, except however, that I enjoin it upon them to sell the negro woman BETTY and MARGARET to the owners of their husbands if they will purchase them and if it be necessary to enduce them to purchase my executors are authorized to sell said woman below the market price of such negroes. I also request my executors that in selling any other of my negroes (herein directed to be sold) whose husbands or wife does not belong to me that they have them find the owners of such husbands or wives upon moderate terms. And further it is my will that members of same family shall not be separated in selling any of the Negroes.

Eleventh. All debts whether by bond, note, open accounts or otherwise due me and all monies on hand at my death I will and bequeath to my two youngest daughters CATHERINE E. PEGUES and EMMA WILLIAM PEGUES to be applied to their education.

Twelfth. All the rest and residue of my Estate not herein before devised and bequeathed I will and bequeath to all my children (Except my son CLAUDIUS PEGUES) and my grandson JOSEPH PEGUES and the son of said CLAUDIUS to be equally divided among them share and share alike, the share given to my grandson JOSEPH it given to him instead of his father in compliance with

his father’s request.

Thirteenth. It is my will that all my just debts be paid.

Lastly. I nominate constitute and appoint my friend Col. Benj. B [E.?] PEGUES and JAMES GILLESPIE my Executors and also appoint them guardians to my two infant daughters CATHERINE E. PEGUES and EMMA WILLIAM PEGUES.

In testimony whereof I have hereunto set my hand and seal this third day of May in the year of our Lord one thousand eight hundred and fifty two.

Signed Sealed and acknowledged by WM. PEGUES as his Last Will & Testament in the presence of of us who in his presence and at his request and in the presence of each other have signed our names as witnesses thereto.

The word "sale" on 3rd line from bottom on second page & the word “the” on the 9th line from top on 3rd page interlined before signed.
