William SMITH, 1814

Marlborough District, SC

In the name of God Amen
          I WILLIAM SMITH of the District of Marlborough & State of South Carolina do make and ordain this my last will and Testament ~~~~

First It is my desire that my Just debts shall be settled & paid.

Item. I give & bequeath unto my loving Son PETER SMITH One Hundred Acres of Land known by my old Place to him & his heirs forever ~~~~

Item. I Give & bequeath unto my youngest Son ALEXANDER SMITH one Hundred Acres of Land more or less being the Place where I now live to him and his heirs forever.

Item. I will & desire that remainder or residue of my Estate of whatsoever Kind that I may die possessed of may be sold at such time and on such credit as my Executors hereafter named, in their discretion may deem most proper with a view that the property may bring its value and the amount thereof when collected or so fully ascertained that a division may take place that it shall be equally divided among all my children, keeping in view that whatever I have heretofore given such of my children as have married or to those unmarried is to be considered as so much of their part received & are not to receive anything more untill those of my Children that have received nothing Shall be made equal with those I have heretofore made advances to, but I wish it understood that it is not my Intention that if any of my Children has received more than an equal part with the rest that they shall account for the overplus ~~~~

Lastly I do hereby nominate, appoint and ordain my Son JOHN SMITH & my Trusty friend THOMAS STUBBS to be Executors to this my last Will and Testament, revoking any Wills by me made. In Witness I have hereunto Set my hand & affixed my Seal this fourth day of August 1814.
